Welcome to Forme Inc. These Terms of Service ("Terms") govern your access to and use of the services provided by Forme Inc ("Forme," "we," "us," or "our"), a Lagree fitness studio located in Burbank, California. These services include, but are not limited to, our website hosted on Squarespace, online scheduling and account services via Mariana Tek, in-studio classes, and any other associated offerings (collectively, the "Services"). By accessing or using any part of our Services, including the website or mobile application, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Services.
1. Eligibility To use the Services, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater. Individuals under the age of 18 may only access the Services with the involvement, supervision, and express written consent of a parent or legal guardian who agrees to be bound by these Terms on their behalf. We reserve the right to refuse service or terminate access to anyone at our sole discretion, including those who do not meet these eligibility requirements.
2. Account Creation and Management All users must create an account through our third-party partner, Mariana Tek, in order to book classes, purchase class packages, and access certain features. You are responsible for providing accurate, current, and complete information during registration and for updating such information to keep it accurate and complete.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree not to share your account with any other person or use another person’s account without permission. You must notify us immediately of any unauthorized use or suspected security breach involving your account.
We are not liable for any loss or damage resulting from your failure to comply with this section.
3. Class Reservations, Packages, and Cancellations
A. Reservations and Payments Reservations must be made through Mariana Tek. You are responsible for ensuring that all class bookings and package purchases are completed properly. We accept major credit cards as forms of payment. Payments must be made in full at the time of purchase, and your account must be in good standing to participate in any classes.
All prices listed are in U.S. dollars and are subject to change without notice. Promotional offers may be time-limited and subject to additional terms.
B. Cancellation Policy Cancellations must be made at least 8 hours prior to the scheduled class time to avoid penalties. Late cancellations and no-shows may result in the loss of a class credit or a cancellation fee.
C. Refund Policy All sales are final. We do not offer refunds on classes, packages, or memberships, except where required by law. If you are unable to attend classes due to medical reasons, we may, at our discretion, offer class extensions or credits upon receipt of appropriate documentation. All refund requests must be submitted in writing.
4. Studio Policies To ensure a safe and welcoming environment for all clients, you agree to adhere to the following studio policies:
Arrive at least 10 minutes before the start of class. Late arrivals may not be admitted and may forfeit their class.
Appropriate athletic attire is required. Grip socks are mandatory for all classes and must be worn at all times in the studio.
You must complete and sign our liability waiver prior to attending your first class.
Refrain from using your phone or other devices during class.
Be respectful to instructors, staff, and fellow clients. Disruptive, inappropriate, or unsafe behavior may result in removal from the premises and/or termination of account access.
5. Assumption of Risk and Waiver of Liability Participation in Lagree fitness classes involves physical activity, which carries inherent risks including, but not limited to, muscle strain, injury, illness, or even death. By using our Services, you acknowledge and voluntarily assume all such risks.
You understand that Forme Inc, its owners, employees, instructors, and affiliates are not liable for any personal injury, property damage, or loss incurred during participation in any class or use of our facilities. You agree to release, indemnify, and hold harmless Forme Inc from any claims arising out of your use of the Services, whether caused by negligence or otherwise.
6. Intellectual Property All materials provided through our Services, including but not limited to text, logos, images, videos, audio clips, designs, and content, are the property of Forme Inc or its licensors and are protected under U.S. and international intellectual property laws. You may not copy, reproduce, distribute, transmit, display, publish, or create derivative works from any content without our prior written permission.
7. Website Hosting and Data Security Our website is hosted by Squarespace, and client account services are managed through Mariana Tek. While we implement appropriate technical and organizational measures to protect your data, no system is completely secure. By using our Services, you consent to the storage and processing of your data in accordance with our Privacy Policy.
We are not responsible for the availability, accuracy, or reliability of third-party systems used in conjunction with our Services.
8. Privacy Policy We take your privacy seriously and handle your personal data in compliance with the California Consumer Privacy Act (CCPA), the California Online Privacy Protection Act (CalOPPA), and other applicable U.S. privacy laws. For details on how we collect, use, and share personal information, please refer to our Privacy Policy available on our website.
9. Communications By creating an account or providing your contact information, you consent to receive communications from us, including emails, text messages, and push notifications. These messages may include transactional updates (e.g., class reminders), promotional content, and service notifications.
You may opt out of marketing messages at any time by following the unsubscribe instructions. However, you may still receive transactional messages necessary for account management and service delivery.
10. Third-Party Services and Links Our Services may contain links to third-party websites or services that are not owned or controlled by Forme Inc. We are not responsible for the content, policies, or practices of third-party websites. You access third-party sites at your own risk, and we recommend reviewing their terms and privacy policies separately.
11. Termination of Service We reserve the right to suspend or terminate your account and access to our Services at our sole discretion, with or without notice, for conduct that violates these Terms or is harmful to other users, our business, or third parties. Upon termination, your right to access or use the Services will immediately cease. You are still responsible for any outstanding payments or obligations.
12. Dispute Resolution and Governing Law These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in Los Angeles County, California, pursuant to the rules of the American Arbitration Association. You waive the right to participate in any class action lawsuit.
13. Modifications to Terms We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective upon posting to our website with the updated effective date. Your continued use of the Services after any changes signifies your acceptance of the revised Terms.
